Promotion Terms & Conditions

(“SOWG Promotion Terms”)
Hosts that qualify for the Special Olympics World Games Promotion (the “Promotion”) will receive a EUR 50 travel coupon to use on the Airbnb Platform (the websites, applications, and other offerings from Airbnb collectively, the “Airbnb Platform”). To qualify, you must:

1. Click on the link for the creation of a new listing in the dedicated landing page: www.airbnb.com/e/specialolympicsworldgames.

2. Hosts must have cookies enabled when they click the opt-in button to ensure they correctly receive the related coupons.

3. Add a new listing located in Berlin within the period from 1st of June to 31st of August 2023.

4. The new listing may not be a copy or duplicate of a pre-existing listing.

5. Ensure that the listing complies with Airbnb’s Legal Terms and applicable laws and rules and you meet our Ground Rules for Hosts, a non-comprehensive general overview of different laws, regulations, and best practices that may affect Hosts can be found in our help centre article Responsible hosting in Germany.

6. Host a Qualifying Stay at your new listing by 31th August 2023. “Qualifying Stay” means: (i) a stay in a new listing published on the Airbnb Platform; (ii) which is located in Berlin; (iii) with check-in between 1st of June to 31st of August 2023; (iv) which isn’t cancelled; and (v) has a minimum booking value of EUR 50 (excl taxes and fees).

The coupons will be credited to the Airbnb account of Hosts that meet the qualification criteria (above under 1.-5.).

Who is the promoter?
The Promotion is promoted by Airbnb Ireland UC, an Irish company with offices at 8 Hanover Quay, Dublin 2, Ireland. For all matters not expressly covered by these programme terms (the “Programme Terms”), Airbnb's terms of service, available at https://www.airbnb.com/terms. All terms that are capitalised and are not defined in these SOWG Promotion Terms shall have the meaning given in the Terms of Service.

How do the coupons work?
These coupons may be redeemed on Airbnb.de and expire on 31st December 2023. These coupons are single-use, meaning that you will not be entitled to use the same coupon on multiple bookings even if the value of the first booking is below the value of the coupon.

Coupons are not exchangeable, transferable or redeemable for cash and may not be applied retroactively or combined with any other coupon or discount code for Airbnb. If you apply the coupon to a booking that you subsequently cancel, any refund owed will not include the coupon amount. You are solely responsible for the correct conservation of the coupon and Airbnb is not responsible if the coupon is lost, stolen, destroyed or used without your permission. Airbnb reserves the right and discretion to any remedy, including denial of the coupon or suspension of your account or bookings, if fraud, misuse, tampering, violations of Airbnb’s Legal Terms, of Airbnb’s Ground Rules for Hosts or of applicable laws and rules or technical errors are suspected. In addition, the Airbnb Coupon Terms and the Guest to Host Program - Travel Coupon - Terms and Conditions apply. If there is a conflict between the Airbnb Coupon Terms and the Guest to Host Program - Travel Coupon - Terms and Conditions, these SOWG Promotion Terms & Conditions will govern.
These accordance with Irish Law. The laws and regulations in force in Ireland relating to contests and sweepstakes also apply to this Promotion, as provided and granted by the relevant English legislation. If you are acting as a consumer and if mandatory statutory consumer protection regulations in your country of residence contain provisions that are more beneficial for you, such provisions shall apply irrespective of the choice of Irish law. As a consumer, you may bring any judicial proceedings relating to these SOWG Promotion Terms before the competent court of your place of residence or the competent court of Airbnb's place of business in Ireland. Applicable law and jurisdiction
These SOWG Promotion Terms are governed by and construed in accordance with Irish Law. The laws and regulations in force in Ireland relating to contests and sweepstakes also apply to this Promotion, as provided and granted by the relevant English legislation. If you are acting as a consumer and if mandatory statutory consumer protection regulations in your country of residence contain provisions that are more beneficial for you, such provisions shall apply irrespective of the choice of Irish law. As a consumer, you may bring any judicial proceedings relating to these SOWG Promotion Terms before the competent court of your place of residence or the competent court of Airbnb's place of business in Ireland. If Airbnb wishes to enforce any of its rights against you as a consumer, we may do so only in the courts of the jurisdiction in which you are a resident. If you are acting as a business, you agree to submit to the exclusive jurisdiction of the Irish courts.

Modification of these Programme Terms
To the extent permitted by applicable law, Airbnb may suspend, modify, or terminate the Promotion if the safety, fairness, integrity, or proper performance of the Promotion is at risk, taking care not to infringe on the rights of Hosts taking part of this Promotion and providing reasonable notice where possible. If anomalies are found in relation to the participation of a Host in connection with the Promotion, Airbnb reserves the right to conduct all necessary checks to verify the fairness and correctness of said participation.

Gastgeber:innen, die sich für die Special Olympics World Games Promotion (die "Promotion") qualifizieren, erhalten einen Reisegutschein im Wert von 50 EUR, den sie auf der Airbnb-Plattform einlösen können (die Websites, Anwendungen und anderen Angebote von Airbnb werden zusammenfassend als "Airbnb-Plattform" bezeichnet). Um sich zu qualifizieren, musst Du:

1. Klicke auf den Link für die Erstellung eines neuen Angebots auf der entsprechenden Landing Page: https://www.airbnb.com/e/specialolympicsworldgames. Gastgeber:innen müssen Cookies aktiviert haben, wenn sie auf den Opt-in-Button klicken, um sicherzustellen, dass sie die entsprechenden Coupons korrekt erhalten.

2. Füge innerhalb des Zeitraums vom 1. Juni bis zum 31. August 2023 ein neues Angebot mit Sitz in Berlin hinzu.

3. Das neue Angebot muss auch Dein erstes Angebot als Gastgeber:in auf Airbnb sein.

4. Stelle sicher, dass das Angebot den rechtlichen Bestimmungen von Airbnb und den geltenden Gesetzen und Regeln entspricht und Du unsere Grundregeln für Gastgeber:innen erfüllst. 5. Beherberge einen qualifizierten Aufenthalt in Deinem neuen Angebot bis zum 31. August 2023. "Qualifizierter Aufenthalt" bedeutet: (i) ein Aufenthalt in einem neuen Angebot, das auf der Airbnb-Plattform veröffentlicht wird; (ii) das sich in Berlin befindet; (iii) mit Check-in zwischen dem 1. Juni und dem 31. August 2023; (iv) der nicht storniert wird; und (v) einen Mindestbuchungswert von 50 EUR (ohne Steuern und Gebühren) hat.

6. Die Gutscheine werden auf dem Airbnb-Konto von Gastgebern:innen gutgeschrieben, die die Qualifikationskriterien erfüllen (siehe oben unter 1.-5.).

Wer ist der Organisator?
Die Aktion wird von Airbnb Ireland UC, einem irischen Unternehmen mit Sitz in 8 Hanover Quay, Dublin 2, Irland, veranstaltet. Für alle Angelegenheiten, die nicht ausdrücklich von diesen SOWG-Aktionsbedingungen abgedeckt werden, gelten die Allgemeinen Geschäftsbedingungen von Airbnb, die unter Airbnb - Nutzungsbedingungen verfügbar sind. Alle Begriffe, die in diesen SOWG-Aktionsbedingungen nicht definiert sind, haben die in den Nutzungsbedingungen angegebene Bedeutung.

Wie funktionieren die Gutscheine?
Diese Gutscheine können auf www.airbnb.de eingelöst werden und laufen am 31. Dezember 2023 ab. Die Gutscheine können nur einmal verwendet werden, d.h. Du bist nicht berechtigt, denselben Gutschein für mehrere Buchungen zu verwenden, selbst wenn der Wert der ersten Buchung unter dem Wert des Gutscheins liegt.
Die Gutscheine können nur einmal verwendet werden und sind nicht erstattungsfähig. Gutscheine können nicht gegen Bargeld, Geschenkkarten oder für frühere Einkäufe eingelöst werden, sind nicht umtauschbar oder übertragbar und können nicht rückwirkend angewendet oder mit anderen Angeboten, Gutscheinen oder Rabattcodes für Airbnb kombiniert werden. Wenn Du den Gutschein auf eine Buchung anwendest, die Du anschließend stornierst, wird der Gutscheinbetrag bei der Rückerstattung nicht berücksichtigt. Du bist allein für die korrekte Aufbewahrung des Gutscheins verantwortlich und Airbnb ist nicht dafür verantwortlich, wenn der Gutschein verloren geht, gestohlen oder zerstört wird oder ohne Deine Zustimmung verwendet wird. Airbnb behält sich das Recht und den Ermessensspielraum vor, Abhilfemaßnahmen zu ergreifen, einschließlich der Verweigerung des Gutscheins oder der Sperrung Deines Kontos oder Deiner Buchungen, wenn der Verdacht auf Betrug, Missbrauch, Manipulationen, Verstöße gegen die rechtlichen Bestimmungen von Airbnb, die Grundregeln für Gastgeber:innen von Airbnb oder gegen geltende Gesetze und Vorschriften oder technische Fehler besteht. Darüber hinaus gelten die Airbnb-Coupon-Bedingungen und die Allgemeinen Geschäftsbedingungen für das Gast-zu-Gastgeber-Programm - Reisecoupon -. Im Falle eines Widerspruchs zwischen den Airbnb Coupon-Bedingungen und den Bedingungen des Gast-zu-Gastgeber-Programms - Reisecoupon - gelten diese SOWG-Aktionsbedingungen.

Anwendbares Recht und Gerichtsbarkeit
Diese SOWG-Promotion-Bedingungen unterliegen dem irischen Recht und werden nach diesem ausgelegt. Die in Irland geltenden Gesetze und Verordnungen in Bezug auf Wettbewerbe und Gewinnspiele gelten auch für diese Aktion, wie in der entsprechenden englischen Gesetzgebung vorgesehen und gewährt. Wenn Du als Verbraucher handelst und zwingende gesetzliche Verbraucherschutzvorschriften in Deinem Wohnsitzland Bestimmungen enthälst, die für Dich vorteilhafter sind, gelten diese Bestimmungen ungeachtet der Wahl des irischen Rechts. Als Verbraucher kannst Du alle gerichtlichen Verfahren im Zusammenhang mit diesen SOWG-Aktionsbedingungen vor dem zuständigen Gericht Ihres Wohnsitzes oder dem zuständigen Gericht des Geschäftssitzes von Airbnb in Irland anstrengen. Wenn Airbnb eines seiner Rechte gegen Dich als Verbraucher durchsetzen möchte, können wir dies nur vor den Gerichten des Landes tun, in dem Du Deinen Wohnsitz hast. Wenn Du als Unternehmer handelst, erklärst Du Dich damit einverstanden, dich der ausschließlichen Gerichtsbarkeit der irischen Gerichte zu unterwerfen.

Änderung dieser Bedingungen und Konditionen
Soweit gesetzlich zulässig, kann Airbnb die Werbeaktion aussetzen, ändern oder beenden, wenn die Sicherheit, Fairness, Integrität oder ordnungsgemäße Durchführung der Werbeaktion gefährdet ist, wobei darauf zu achten ist, dass die Rechte der Gastgeber:innen, die an dieser Werbeaktion teilnehmen, nicht verletzt werden und nach Möglichkeit eine angemessene Ankündigung erfolgt. Sollten Unregelmäßigkeiten im Zusammenhang mit der Teilnahme eines Gastgebers:innen an der Werbeaktion festgestellt werden, behält sich Airbnb das Recht vor, alle notwendigen Kontrollen durchzuführen, um die Fairness und Korrektheit der Teilnahme zu überprüfen.
